Terms of service
These terms are the agreement between you and Tradeday, of New South Wales, Australia ("we", "us"), covering the TradeDay website and app. By using TradeDay you accept them. If you do not, do not use it.
What TradeDay is
TradeDay helps you plan a working day: it suggests an order for your stops, estimates when to leave, times your jobs, learns how long your work actually takes, and helps you price quotes from those numbers. It is a planning aid. It is not navigation, not accounting software, and not tax advice.
Your account and your data
You can use TradeDay without an account, in which case your data stays on your device and you are solely responsible for keeping it. If you create an account you are responsible for keeping your sign-in secure and for everything done through it.
Your business data is yours. We claim no ownership of it and do not use it for anything except running the service for you. You can export it or delete it at any time, as described in our privacy policy.
You are responsible for having the right to store any customer information you enter, and for complying with the privacy laws that apply to your business.
Plans and billing
- Free costs nothing and includes one sorted run a day, ten job types and three quotes a month, with learned durations included.
- Pro is US$19 per month or US$180 per year for your whole business, with no per-user charge, and removes those limits.
Pro is billed in advance through Stripe. You can cancel at any time and keep Pro until the end of the period you have already paid for. We do not refund part periods, except where the Australian Consumer Law requires it. If we change the price we will tell you at least 30 days before it applies to you.
If your subscription lapses you return to the free plan. Nothing is deleted, nothing is locked, and your exports keep working.
Acceptable use
You agree not to:
- use TradeDay for anything unlawful, or to store information you are not entitled to hold;
- attempt to break, overload, probe or circumvent the service, its rate limits or its plan limits;
- resell or redistribute the service, or use it to build a competing product;
- operate the app while driving, or in any way that endangers you or anyone else.
Availability
We aim to keep TradeDay working but do not promise it will be uninterrupted or error-free. Live traffic routing, address search and cloud backup depend on third parties and on your connection, and may be unavailable. The core planning features are designed to keep working offline.
Estimates are estimates
Drive times, arrival times, learned durations, quoted prices and logbook records are calculated from the data available and are estimates. You are responsible for checking anything that matters — particularly prices you give a customer and records you give to your accountant or tax authority.
Warranties and liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. Where the law allows us to limit our liability, we do so: TradeDay is otherwise provided "as is", and to the extent permitted by law our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim, or the resupply of the service. We are not liable for lost profits, lost work, or indirect or consequential loss.
Ending it
You can stop using TradeDay whenever you like and delete your data from Setup. We may suspend or end your access if you materially breach these terms, and will tell you why unless we are prevented from doing so.
Changes to these terms
We may update these terms. If a change materially affects you we will tell you in the app or by email before it takes effect. Continuing to use TradeDay after that means you accept the new terms.
Governing law
These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that state.
